Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Secure ("Secure," "we," "us," or "our") and govern your use of the Secure iOS application and any related support services we provide through the app. By downloading, accessing, or using Secure, you agree to these Terms and to our Privacy Policy.

1. Eligibility

Secure is intended only for people who are at least 13 years old. By using Secure, you represent and warrant that you are at least 13 years old and are legally able to agree to these Terms. If you are under 18, you are responsible for making sure your use of the app is permitted under the laws that apply to you.

2. What Secure Is

Secure is a self-guided breakup support and journaling app. It may offer tools such as daily check-ins, a no-contact counter, breathing exercises, breakup journaling prompts, and guided reflection exercises. Secure is designed for personal wellness and reflection only.

3. Not Medical, Mental Health, Or Crisis Care

Secure is not a medical device, therapist, psychiatrist, psychologist, licensed counselor, crisis service, or emergency response provider. The app does not provide medical advice, mental health diagnosis, treatment, or therapy. Content in Secure is informational and self-help in nature and is not a substitute for professional advice, diagnosis, treatment, or crisis intervention.

If you are in danger, believe you may harm yourself or someone else, or need urgent help, do not rely on Secure. Call 911 or your local emergency services immediately. If you are in the United States, you can also call or text 988 to reach the Suicide & Crisis Lifeline.

4. License To Use The App

Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to download and use Secure on Apple-branded devices that you own or control, solely for your personal, non-commercial use and only as permitted by the Apple App Store Usage Rules.

Secure is licensed, not sold. We and our licensors retain all rights, title, and interest in the app, including all software, designs, branding, text, graphics, and other content made available by us, except for your journal entries and other content that you create in the app.

5. Your Content And Your Responsibilities

You retain ownership of the journal entries, responses, notes, and other content you create in Secure ("User Content"). If you choose to use sign-in and cloud backup features, you authorize us and our service providers to host, transmit, store, and process your User Content solely as needed to operate, secure, back up, sync, restore, and support the app.

You are responsible for your User Content and for your use of Secure. You agree not to use Secure in any unlawful, abusive, harmful, fraudulent, infringing, or disruptive way, including by attempting to interfere with the app, reverse engineer the app except where applicable law clearly allows it, or upload content that violates another person's rights.

6. Local Storage, Sign-In, And Cloud Backup

Secure is designed to store your data locally on your device by default. If you choose to sign in with Apple or Google, Secure may sync certain app data to Firebase services so you can restore it across devices or after reinstalling the app. Data that may sync includes your journal entries, daily check-ins, guided exercise progress, settings, prompt history, and no-contact date.

You are responsible for maintaining access to the Apple or Google account you use for sign-in. We are not responsible for problems caused by your device, operating system, Apple account, Google account, internet connection, or third-party service outages. We do not guarantee that local data or cloud backups will always be available, error-free, or fully recoverable.

7. Privacy

Your privacy matters to us. Our Privacy Policy explains how Secure handles your information and is incorporated into these Terms by reference.

8. Feedback And Communications

If you contact us or send feedback, you grant us the right to use that feedback without restriction or compensation to improve Secure, provided we do not publicly identify you without your permission. If you email us, we may keep a copy of that communication to respond to you, support the app, and keep reasonable business records.

9. App Updates, Changes, And Availability

We may update, modify, suspend, or discontinue all or part of Secure at any time, including to improve functionality, address bugs or security issues, or comply with law. We may also update these Terms from time to time. If we make material changes, we may provide notice in the app or by other reasonable means. Your continued use of Secure after updated Terms take effect means you accept the updated Terms.

10. Termination

You may stop using Secure at any time. We may suspend or terminate your access to Secure if you violate these Terms, misuse the app, create risk for us or others, or if we are required to do so by law. Termination of your right to use the app does not limit any rights or remedies that either party may have under applicable law.

If you delete your signed-in account and cloud backup through the app, the cloud backup data associated with that account will be removed, but local data on your device may remain unless you separately delete it from the app or remove the app from your device.

11. Third-Party Services And App Store Terms

Secure may rely on third-party services such as Apple, Google, and Firebase to support sign-in, distribution, hosting, or app functionality. Your use of those third-party services may also be subject to their own terms and privacy policies, and we are not responsible for third-party products or services.

If you obtained Secure through the Apple App Store, you acknowledge that these Terms are between you and Secure, not Apple, and that Apple is not responsible for the app or its content. To the maximum extent permitted by applicable law, Apple has no obligation to furnish maintenance or support services for Secure. If the app fails to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price, if any, paid for the app. Except as required by law, Apple has no other warranty obligation with respect to Secure. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as applicable.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, QUIET ENJOYMENT, ACCURACY, OR THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

We do not guarantee that Secure will meet your requirements, improve your mental health, prevent emotional distress, preserve all of your data, or be compatible with every device, operating system version, or network connection.

13. Limitation Of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SECURE AND ITS AFFILIATES, LICENSORS, SERVICE PROVIDERS, AND PERSONNEL WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, GOODWILL, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF OR INABILITY TO USE THE APP.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO SECURE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, FOR USE OF THE APP IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) FIFTY U.S. DOLLARS (USD $50).

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, including certain rights that may apply under consumer protection laws.

14. Indemnity

To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless Secure and its affiliates, service providers, and personnel from and against claims, liabilities, damages, judgments, awards, losses, costs, and expenses arising out of or relating to your misuse of Secure, your User Content, or your violation of these Terms or applicable law.

15. Governing Law And Venue

These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules, except to the extent that mandatory consumer protection law in your jurisdiction requires otherwise. Unless applicable law says otherwise, any dispute arising out of or relating to these Terms or Secure will be brought exclusively in the state or federal courts located in California, and you and Secure consent to the personal jurisdiction of those courts.

16. General

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full force to the maximum extent permitted by law. Our failure to enforce any provision is not a waiver of that provision. These Terms, together with the Privacy Policy, are the complete agreement between you and Secure regarding your use of the app.
